These Terms of Service ("Terms") govern your access to and use of Align ("the App"), a dating application operated by Hakeem Awbrey ("we," "us," or "our"). By using Align, you agree to these Terms. If you do not agree, please do not use our services.

1. About Align

Align is a dating application designed to help users connect with people who truly align with their values, interests, and preferences. Our platform goes beyond superficial swiping to facilitate meaningful connections based on genuine compatibility.

2. Eligibility

To use Align, you must:

• Be at least 18 years of age
• Create only one account for personal use
• Provide accurate and truthful information
• Not be prohibited from using our services under applicable laws
• Not have been previously banned or removed from Align for violating these Terms

3. Account Registration and Security

When you create an account:

• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate, current, and complete information
• You must not impersonate others or create fake profiles
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree NOT to:

• Use the App for any illegal, harmful, or fraudulent purposes
• Harass, abuse, threaten, or intimidate other users
• Post or share inappropriate, offensive, or explicit content
• Spam, solicit money, or engage in commercial activities without permission
• Attempt to hack, reverse engineer, or compromise the App's security
• Use automated systems (bots, scrapers) to access the App
• Violate any applicable laws, regulations, or third-party rights
• Upload content containing viruses, malware, or harmful code
• Infringe on intellectual property rights of others

5. User Content

Regarding content you upload to Align:

• You retain ownership of your content (photos, profile information, messages)
• You grant us a license to use, display, and distribute your content as necessary to operate the App
• You are responsible for the content you post
• We reserve the right to remove content that violates these Terms
• You must have the rights to all content you upload

6. Privacy and Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using Align, you consent to our data practices as described in the Privacy Policy.

7. Subscriptions and Payments

Align may offer both free and paid subscription services:

• Subscription fees are billed in advance on a recurring basis
• You authorize us to charge your payment method for all fees
• Subscriptions auto-renew unless cancelled before the renewal date
• Refunds are provided at our discretion and in accordance with applicable laws
• We reserve the right to change pricing with notice

8. Account Termination

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activity
• You harass or harm other users
• We are required to do so by law
• Your account has been inactive for an extended period

You may delete your account at any time by contacting support@comealign.com or visiting our Data Deletion page. Upon termination, your access to the App will cease, and your data will be deleted in accordance with our Privacy Policy.

9. Disclaimer of Warranties

Align is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, including:

• That the App will be uninterrupted, secure, or error-free
• That matches or connections will lead to successful relationships
• The accuracy or reliability of user-generated content
• The conduct, safety, or legitimacy of other users

We do not conduct background checks on users. You are responsible for your own safety and should exercise caution when meeting people from the App.

10. Limitation of Liability

To the fullest extent permitted by law, Align and its operators shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Damages arising from your use or inability to use the App
• Any conduct or content of third parties, including other users
• Unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid us in the past 12 months, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Align, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit or share on the App

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of Align shall be resolved through:

1. Good faith negotiation between you and Align
2. If negotiation fails, binding arbitration in accordance with the Federal Arbitration Act and applicable state laws
3. The exclusive jurisdiction of courts located in the United States for any matters not subject to arbitration

13. Intellectual Property

All content, features, and functionality of Align (including but not limited to text, graphics, logos, software, and design) are owned by Align or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our express written permission.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of Align after changes are posted constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
